Documentation from seller necessary for signing a property sale at the Notary
If the seller is a private person(s)
- DNI or passport + NIE of all sellers
- Original escritura from purchase (if possible)
- If the seller is a company
- Document showing that the person who is signing can legally represent the company (Escritura de constitución or Escritura de poder)
- DNI or passport + NIE
- Original escritura from purchase (if possible)
Certificates
- Certificate of no debt from the owners association, if applicable (Certificado no deudor de la comunidad de propietarios)
- Certificate of no debt from the electricity supply company (Certificado no deudor de suministro de luz)
- Certificate of no debt from the water supply company (Certificado no deudor de suministro de agua)
- Certificate of no debt from the Town Hall, for yearly property tax and rubbish (Certificado no deudor de Ayuntamiento, IBI + Basura)
- Energy efficiency certificate (Certificado eficiencia energetica)
If any of the above-mentioned certificates come out negative and there are unpaid debts on the property, these amounts can be retained from the sales price and paid to the pending party directly from the notary.
In case the property has a mortgage
Certificate of cancellation of mortgage, this has to be calculated by the bank for the exact date of the sale (Certificado de cancelación de hipoteca). If you wish to receive the sales price per bank transfer, remember to bring the IBAN number so the notary can make the transfer. Last but not least, remember to bring all the keys to the property, these shall be given to the buyer during the signing in Notary.
